OVERVIEW
Welcome to JANE DOPE. The terms “we,” “us” and “our” refer to JANE DOPE Inc. JANE DOPE operates this online store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).
Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you access or use the Services.
By visiting, interacting with or using our Services, including purchasing a product, you agree to be bound by these Terms and our Privacy Policy, available at https://www.janedope.ca/pages/privacy-policy.
If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your province, state or jurisdiction of residence, or that you have obtained any consent required for your use of the Services.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring through your account.
You agree that information you provide to us, including account, billing, shipping and contact information, will be current, complete and accurate.
We reserve the right to refuse service, terminate accounts or restrict access to the Services where reasonably necessary to protect JANE DOPE, our customers, our service providers or other parties, or where these Terms have been violated.
SECTION 2 — OUR PRODUCTS
We make reasonable efforts to present our products and their characteristics accurately.
Colours, textures, prints, proportions and other visual characteristics may appear differently depending on your screen, device settings, lighting, production method, fabric and other factors.
Product availability, designs, specifications and pricing may change without notice.
Some JANE DOPE products are produced or fulfilled on a made-to-order or print-on-demand basis. Reasonable variations may occur between individual items as a result of manufacturing, printing, fabric characteristics, placement, cutting or production tolerances.
These reasonable production variations are not necessarily defects.
We reserve the right to discontinue products, limit quantities or restrict sales of products where reasonably necessary.
SECTION 3 — SIZING AND FIT
Sizing may vary between JANE DOPE products, manufacturers, garment types and fabrics.
Customers are responsible for reviewing the size chart, measurements, product specifications and fit information associated with the individual product before purchasing.
References to standard sizes such as XS, S, M, L, XL or extended sizes should not be assumed to correspond exactly to sizing from another brand or product.
Any sizing recommendation, including recommendations generated by an automated or AI-assisted sizing tool, is intended to assist with your purchasing decision and does not guarantee fit.
SECTION 4 — AI-ASSISTED CONTENT AND PRODUCT VISUALIZATION
JANE DOPE uses artificial intelligence and other digital creative technologies as part of our design, editorial, marketing and online shopping experience.
This may include AI-assisted or AI-generated product imagery, editorial imagery, artwork, graphics, written content, styling concepts, product visualizations and interactive shopping tools.
Some product images may be digitally created, generated, composited or enhanced to demonstrate the intended appearance, styling, fit, scale or use of a product. These images are visual representations and may not depict a photographed physical sample.
We make reasonable efforts to ensure that material product characteristics, including product designs, prints, colours, proportions and garment details, are represented as accurately as reasonably possible.
Because screen settings, production processes, fabric characteristics, printing methods and reasonable manufacturing tolerances can affect appearance, a finished product may vary from a digital or photographic representation displayed through the Services.
Product descriptions, specifications, measurements and size charts should therefore be reviewed when making a purchasing decision. Where there is a material discrepancy between a product visualization and the written product specifications, the written specifications will govern.
JANE DOPE may also provide AI-assisted sizing, recommendation, search, customer-service or shopping tools. These tools are designed to assist customers and may generate recommendations based on information supplied by the customer, product information and other available information.
AI-assisted recommendations are not guarantees of fit, suitability or outcome.
Where an AI-powered feature processes personal information you provide, our collection, use, disclosure and handling of that information is governed by our Privacy Policy and applicable law.
SECTION 5 — ORDERS
An order submitted through our Services constitutes an offer to purchase. We reserve the right to accept, decline or cancel an order as permitted by applicable law.
Receipt of an automated order confirmation does not necessarily constitute final acceptance of an order.
We may cancel or limit an order where we reasonably believe there has been an error, pricing issue, suspected fraud, unauthorized activity, inventory or fulfillment issue, or violation of these Terms.
If we cancel an order after payment has been processed, we will issue any refund required by applicable law and our policies.
You are responsible for providing accurate billing, payment, contact and shipping information.
SECTION 6 — PRICES AND PAYMENT
Prices displayed through the Services may change without notice.
Unless otherwise indicated, applicable taxes, shipping charges, duties or other charges may be calculated and displayed during checkout.
You agree to provide valid and authorized payment information and authorize us and our payment service providers to charge the amounts associated with your purchase.
We reserve the right to correct pricing, description or other errors as permitted by applicable law.
SECTION 7 — SHIPPING, DELIVERY AND MADE-TO-ORDER FULFILLMENT
Shipping and delivery estimates are estimates only and are not guaranteed unless expressly stated otherwise.
Made-to-order and print-on-demand products may require production time before shipment.
Delivery may be affected by carriers, customs, weather, production delays, holidays and other circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address.
International customers may be responsible for duties, taxes, customs charges or other fees imposed by the destination jurisdiction unless otherwise stated at checkout.
SECTION 8 — RETURNS, EXCHANGES AND REFUNDS
Returns, exchanges and refunds are governed by the Return and Refund Policy displayed through our Services.
Because certain products may be produced specifically after an order is placed, eligibility for returns or exchanges may differ from conventional stocked merchandise, subject always to applicable consumer-protection laws.
Please review the applicable return policy before completing your purchase.
Nothing in these Terms is intended to limit rights or remedies that cannot lawfully be excluded under applicable consumer-protection legislation.
SECTION 9 — PROMOTIONS AND DISCOUNTS
Promotional offers, discount codes, giveaways, sales and other offers may be subject to additional terms, eligibility requirements, expiration dates and exclusions.
Unless otherwise stated, promotional offers cannot necessarily be combined.
We reserve the right to modify or discontinue promotions as permitted by law.
SECTION 10 — EMAIL AND SMS COMMUNICATIONS
Where you provide the consent required by applicable law, JANE DOPE may send you promotional communications by email or SMS/text message.
SMS communications may include promotions, product announcements, shopping reminders and abandoned-cart or abandoned-checkout messages.
Consent to receive marketing communications is not a condition of purchase.
Message frequency may vary and message and data rates may apply.
You may unsubscribe from promotional emails using the unsubscribe mechanism contained in those communications.
You may opt out of promotional SMS messages by replying STOP where supported. Reply HELP where supported for assistance.

SECTION 11 — THIRD-PARTY TOOLS AND SERVICES
The Services may contain or rely upon tools, applications, integrations, payment processors, fulfillment providers, analytics platforms, advertising services, AI technologies and other services provided by third parties.
We may provide access to these services without controlling every aspect of their operation.
Your use of certain third-party services may also be subject to the third party's own terms and privacy practices.
To the extent permitted by law, JANE DOPE is not responsible for the independent acts, omissions, content or services of third parties that are outside our reasonable control.

The Services may contain links to third-party websites or resources.
A link does not necessarily constitute our endorsement of the third party.
We are not responsible for the content, accuracy, policies, products or practices of third-party websites outside our control.
You should review the applicable terms and privacy policies before engaging with a third-party service.
SECTION 13 — INTELLECTUAL PROPERTY
The Services and the content made available through them may include JANE DOPE names, trademarks, logos, designs, prints, artwork, graphics, photographs, digital imagery, text, videos, layouts and other creative materials.
Except where otherwise stated or where rights belong to a third party, these materials are owned by, licensed to or otherwise lawfully used by JANE DOPE and are protected to the extent provided by applicable intellectual-property laws.
You may use the Services for your personal, non-commercial use.
You may not reproduce, distribute, sell, commercially exploit, scrape, republish or create unauthorized derivative works from protected JANE DOPE materials except with our written permission or where otherwise permitted by law.
JANE DOPE may use artificial intelligence and other digital tools as part of its creative process. Nothing in these Terms grants users additional rights to JANE DOPE branding, source materials or other protectable content merely because an AI or digital tool was involved in its creation.
SECTION 14 — REVIEWS, PHOTOS AND USER CONTENT
If you submit a review, photograph, video, comment, testimonial or other content to JANE DOPE, you represent that you have the right to submit that material and that it does not violate the rights of another person.
Where permitted by applicable law and the terms presented when content is submitted, you grant JANE DOPE a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt and share submitted content in connection with our website, social media, advertising, marketing and other business communications.
You retain ownership of rights you hold in your original content.
We reserve the right to moderate or remove content that is unlawful, abusive, misleading, infringing, fraudulent, discriminatory, obscene, spam or otherwise inappropriate for our Services.
SECTION 15 — PROHIBITED USES
You may not use the Services:
(a) for unlawful or fraudulent purposes;
(b) to violate applicable laws or regulations;
(c) to infringe intellectual-property or privacy rights;
(d) to transmit malicious code or interfere with the security or operation of the Services;
(e) to scrape, harvest or collect information through unauthorized automated means;
(f) to impersonate another person or misrepresent your identity;

Occasionally, information available through the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping or other information.
We reserve the right to correct errors and update information as permitted by applicable law.

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
We do not warrant that the Services will always be uninterrupted, timely, secure or error-free.
Nothing in these Terms excludes warranties, conditions, guarantees or other rights that cannot lawfully be excluded.
SECTION 19 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, JANE DOPE and its directors, officers, employees, affiliates, contractors, service providers and agents will not be liable for indirect, incidental, special, punitive or consequential losses arising from your use of the Services where such liability may lawfully be limited or excluded.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, or any mandatory rights available to consumers under applicable law.
SECTION 20 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless JANE DOPE and its affiliates, officers, directors, employees and agents from third-party claims, liabilities, damages and reasonable costs arising from your unlawful use of the Services, your material breach of these Terms or your infringement of another person's rights.
SECTION 21 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary, and the remaining provisions will continue in effect.
SECTION 22 — WAIVER
Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.
SECTION 23 — ENTIRE AGREEMENT
These Terms and the policies or operating rules referenced in them constitute the agreement between you and JANE DOPE concerning your use of the Services, subject to any additional terms that expressly apply to a particular product, promotion or service.
SECTION 24 — ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our consent where such restriction is permitted by applicable law.
We may assign our rights and obligations in connection with a merger, acquisition, corporate reorganization, sale of assets or similar transaction, subject to applicable law.
SECTION 25 — GOVERNING LAW
These Terms and your use of the Services are governed by the laws applicable in the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to conflict-of-law principles, except where mandatory consumer-protection laws in your jurisdiction provide otherwise.
Nothing in this section deprives a consumer of protections that cannot lawfully be waived under the laws applicable to them.

We may update these Terms from time to time to reflect changes to our Services, business practices, technology or legal requirements.
Updated Terms will be posted through the Services with an updated revision date where appropriate.
Your continued use of the Services following an update constitutes acceptance to the extent permitted by applicable law.
